GENERAL TERMS AND CONDITIONS – Bistro Francis – october 2023

1 Agreement

Subject to special written provisions issued by an authorized person, these current general terms and conditions apply to all commitments made by Bistro Francis represented by Kint Operations BV.

These terms and conditions are stated on the website www.bistrofrancis.nl; thus, they have been adequately communicated. Implicit acceptance is sufficiently demonstrated by visiting our location or receiving our documents or services.

2 Payment Terms

Our invoices are payable on the invoice date without any discount. Individual guests are required, under the penalty of automatic cancellation, to provide a credit card guarantee when making a reservation. In case the invoice is not paid, in full or in part, within 14 days, the guest is automatically liable to pay a compensation fee of 5% of the invoice amount.

Interest and compensation fees are due solely by the fact of non-payment. Payments made after a delay in payment will first be credited to interest and compensation fees, and only then to the invoice amount. Never can the failure to take possession of the provided accommodations, an incomplete and/or disputed stay, reservation, and/or service by the guest serve as an excuse for a delay in payment. Any delay in payment gives the hotel the unilateral right to cancel all existing and unexecuted agreements with the buyer without compensation and to suspend the execution of ongoing agreements.

3 Description

The descriptions, sizes, colors, as well as details of photos and/or drawings in price quotes, catalogs, websites, booking sites, and social media are purely informative and never binding.

4 House Rules

Allergens – If you have dietary requirements, such as an intolerance or allergy, please mention this when making your reservation. When booking online, you can specify this in the ‘dietary requirements, allergies, or other comments’ field. The menu information provided by us should not be considered the sole form of guarantee. Based on your personal circumstances, you should assess the risk level before consuming our dishes. Corkage – You are welcome to bring your own wine that is not on our wine list. The corkage fee is €30 per 750ml bottle. Credit Card Guarantee – For parties of five or more and during busy periods, we request a credit card guarantee when making a reservation. We do this to prevent no-shows and to avoid unnecessary disappointments. The cancellation policy and no-show fee are stated in the reservation confirmation. Minors – We do not serve alcohol to those under 18 years of age or to those who cannot provide identification upon the request of one of our employees, even if accompanied by a legal adult. No Smoking – Our restaurant is entirely smoke-free, but smoking is allowed on the terrace. No-show – If you fail to notify us of a cancellation, a fee will be charged to your credit card. The amount of this fee is specified in your reservation confirmation. Pets – Pets are not allowed in the restaurant but are allowed on the terrace. We also provide a bowl of water or a dinner dish for dogs. Reservation Changes – We appreciate it when you notify us of changes in a timely manner. If you do not do so, or if you make changes on the day of the reservation, we cannot guarantee your changes. Confirmation – We will contact you via email, SMS, or phone to confirm your reservation. We reserve the right to cancel your reservation if we do not receive confirmation. Late Arrival – Please contact us if you will be late. If you do not inform us, we may release your table after 20 minutes. Table Preferences – We will consider your preferences, but a specific table or location preference can never be guaranteed. This also applies to our terrace. Groups & Events – For groups, with timely requests, we can reserve private dining. If you have other requests, a special occasion, or want to reserve the entire restaurant, please contact us.

5 Check-in and Check-out at Hotel Kint

Reserved accommodations are available from 3:00 PM on the day of arrival and must be vacated by 11:00 AM at the latest on the day of departure. If a guest with a guaranteed reservation does not appear at the specified time, the hotel has the right to charge the guest a compensation fee equal to the total reservation value, including any requested additional services.

6 Complaints

Any complaint regarding a meal at Bistro Francis, a stay at Hotel Kint, goods, and/or an invoice should be reported by the guest as soon as possible during their visit to the respective organization, to give the management the opportunity to address the complaint immediately.

In any case, the complaint must be made in writing, within eight days of delivery, service, and/or invoice, under penalty of forfeiture.

7 Force Majeure

In case of force majeure, unforeseen events beyond its control, and/or exceptional circumstances, the hotel and restaurant reserve the right to accommodate the guest, without any form of compensation, in another hotel or restaurant, if possible in the vicinity.

8 Damages

Any damage caused by the guest to accommodations, furnishings, and/or other items belonging to or in connection with the hotel/restaurant, shall be paid in cash, without dispute, according to the statement accepted by the guest, no later than before the guest’s departure. With regard to parking vehicles in the hotel’s parking lot, as well as in facilities belonging to third parties with which the hotel and restaurant have relations, it is agreed that Kint Operations BV is released from all responsibility for any reason, such as, without limitation, damage, theft, and/or disappearance of the vehicle or items located in, on, or attached to the vehicle, as well as any bodily injury to guests or third parties that may be caused by anyone or anything in these areas.

9 Disputes

In any dispute, regardless of where the action, service, or agreement takes place, only the court is competent, exclusively in accordance with Dutch law. Bills of exchange and different payment terms do not change this competence. The guest accepts these general terms and conditions at the time of reservation. The guest acknowledges knowing, understanding, and agreeing to these terms and also undertakes to comply with the customary house rules (Art. 4) of Kint Operations and the instructions provided by the staff. The staff is entitled to terminate the provision of catering services to a guest at any time and without notice if the guest repeatedly violates the house rules or behaves in such a way that disrupts the order and peace in the catering establishment and/or its normal operation. In that case, the guest must leave the hotel upon the first request.

10 General Terms and Conditions – Events

Payment Conditions:

Upon acceptance of the quotation, an advance payment of 50% will be requested, which must be paid within 7 days of the invoice date. Within 60 days before the start of the event, a second advance payment of 25% will be requested, which must be paid within 7 days of the invoice date. If acceptance of the quotation falls within 60 days before the start of the event, we will request a single advance payment of 75%, which must be paid within 7 days of the invoice date. After the completion of the event, the remaining 25% of the accepted quotation + additional consumption based on post-calculation will be invoiced. This invoice must be paid within 7 days of the invoice date.

Cancellation Conditions:

Up to 60 days before arrival, a maximum of 50% of the confirmed reservation can be canceled free of charge. From 60 to 30 days before the start of the event, a maximum of 25% of the confirmed reservation can be canceled free of charge. From 29 to 8 days before the start of the event, 90% of the reservation value will be invoiced. From 7 days to the day of the event, No show or an earlier departure date will result in 100% of the reservation value being invoiced.

Other Event Terms:

Changes in numbers can be communicated up to 30 days before the start of the event, with a deviation of up to a maximum of 20% being accepted. From 29 days before the start, any change in numbers will result in the full amount being invoiced.

Groups: Reservations for 8 or more persons will be treated as group reservations.

11 General Terms and Conditions – General

Payment Conditions:

Upon acceptance of the price proposal, an advance payment of 50% will be requested, which must be paid within 7 days of the invoice date. At check-out, the remaining 50% of the price proposal + additional consumption during the stay based on post-calculation will be settled on-site.

Cancellation Conditions:

Up to 60 days before arrival, a maximum of 50% of the confirmed reservation can be canceled free of charge. From 60 to 30 days before the start of the group, a maximum of 25% of the confirmed reservation can be canceled free of charge. From 29 to 8 days before the start of the group, 90% of the reservation value will be invoiced. From 7 days to the day of the group’s arrival, No show or an earlier departure date will result in 100% of the reservation value being invoiced.

Individual Reservations (1 to 4 rooms)

12 Credit Card Guarantee

The guest will provide a credit card at check-in, and Kint Operations BV will record the details. If the guest does not make the payment within the agreed timeframe or uses facilities (e.g., bar, restaurant, etc.) that are not reported at check-out, the hotel has the right to charge the credit card, provided that the billing details are delivered to the guest, either electronically or by mail. In any case, the guest must protest the payment made within 8 days in writing if they believe it to be incorrect.

Article 1152 of the Civil Code is applicable in this case.
